Privacy Policy

Festival Napa Valley (“FNV”) places a high priority on protecting your privacy. This privacy policy was created in order to demonstrate FNV’s firm commitment to the privacy of our members and website users. It explains what types of information are collected by throughFNV’s website, festivalnapavalley.org (the “Site”), and how this information is used. It applies to all information received by FNV or through the Site, both online and offline, on any platform, as well as any electronic, written, or oral communications.

What Personally Identifiable Information is Collected


Individuals and organizations that sign up to receive FNV e-communications voluntarily provide FNV with contact information (such as name and e-mail address). We may use this information for specific, limited purposes. You may always "opt out," either now or at any time in the future, if you do not wish to receive our messages.

If individuals and organizations make donations to FNV or provide personal information to FNV via the mail, phone or other off-line methods, information collected will include that required to process membership or donor transactions, yet is normally limited to name, phone, email, mailing address, and payment information.

If individuals and organizations purchase tickets to FNV events and performances, we will collect the information required to process payment and/or fulfill these purchases. This could include address information, email, phone, name, guests’ names, and guest dining preferences.

From time to time, FNV may also ask users to provide other optional information.  If a user chooses to provide such information, the user is giving FNV the permission to use and store this information consistent with this privacy policy.

IP addresses


FNV may use your IP address to help diagnose problems with our server, to administer the Site, and for statistical metrics used to track visitor traffic.

Cookies


The Site uses "cookie" data to automatically help provide better services. This data reminds us who you are and of your preferences for the Site based on what you've done and told us before. The "cookie" is placed in your computer and is read when you come back to the Site. Cookies let us take you to the information and features you're particularly interested in. They also let us track your usage of the Site, so we know which parts of our sites are most popular. You can reject cookies or disable them by instructing your Web browser accordingly, but this may impact your ability to interact with the Site.

How Your Information May Be Used


We use your personal information to provide you with personalized service; to send e-mail alerts or communications to you; to answer your requests; to process your membership application; etc. You may choose to opt out from our email list at any time, which will cease all electronic e-newsletter communications from us (but individual, direct emails can continue). The e-mails we send to you may contain code, which allows FNV to track usage of the e-mail, including whether the e-mail was opened and/or what links (if any) were clicked. We may also use your information to track visitors of our website. This lets us see which of our features are the most popular so we can better serve our users' needs. It also lets us provide aggregate data about our traffic (not identifying you personally, but showing how many visitors used which features, for example) to outside parties.

Information collected offline from donors will be used exclusively to process memberships, tickets and donations, or to compile and send mailings through the US Postal Service. To opt out of such mailings will require the recipient to contact FNV at the address below.

Your Privacy


FNV does not not sell, rent, or trade our donors' or subscribers’ names, email addresses, mailing addresses, or donation information with any other entity or organization.

We will share personal information with third parties if we have a good-faith belief that such disclosure is reasonably necessary to (i) comply with any applicable law, regulation, legal process, or enforceable governmental request; (ii) enforce any applicable Terms of Service; (iii) detect, prevent, or otherwise address fraud, security, or technical issues; or (iv) protect against harm to the rights, property, or safety of FNV, our customers or users, or the public.

Donations & Purchases


To the extent any donations or purchases are processed through a third-party service provider (e.g. credit card processing company), our donors’ information will only be used for purposes necessary to process the donation.

External Links


Users may find logos or other content on the Site that links to the sites and services of our partners, suppliers, sponsors, licensors, and other third parties. We do not control the content or links that appear on these sites and are not responsible for the practices employed by websites linked to or from the Site. In addition, these sites or services, including their content and links, may be constantly changing. These sites and services may have their own privacy policies and terms of service, and browsing or interacting on any other website, including those which have are linked to or from the Site, is subject solely to those third party privacy policies and terms of service.

Security


FNV is committed to maintaining and protecting your privacy as a visitor to the Site. We remind you, however, that the Internet is not a secure medium. As such, your privacy cannot be guaranteed when you communicate online or otherwise visit this or any website. The nature of Internet communication means that your communications may be susceptible to data corruption, interception, and delays. FNV takes no responsibility for such events.

FNV will exercise reasonable care in providing secure transmission of information between the user’s computer and FNV’s servers, and the storage of information on those servers. However, FNV cannot ensure or warrant the security of any information transmitted over the Internet and accepts no liability for any unintentional disclosure. FNV also cannot ensure or warrant the security or stability of any user’s computer for reasons including, but not limited to, viruses, Trojan horses, worms, or other types of malware. Statements made in this Privacy Policy, regarding FNV’s privacy policies, are only intended to apply to intentional disclosures.

Limitation of Liability


The Site is created solely for the use of adults thirteen (13) years of age and older who are residents of the United States. FNV will act in accordance with federal, state and local laws. Use of FNV’s services and/or the Site is at the risk of the user, and FNV disclaims all responsibility for any loss, injury, or other damage that might be suffered in consequence of any reliance upon or exposure to any part of the Site and related services.

Acceptance and Modifications


We encourage you to read this Privacy Policy carefully when using the Site or transacting business with us. This Privacy Policy is intended to describe to you, as an individual user of FNV’s services and/or the Site, the information we collect, how that information may be used, with whom it may be shared, and your choices about such uses and disclosures. By using this Site, and/or registering for a FNV event, users are accepting and consenting to the practices set forth in this policy.

To better serve our customers and support our objectives, we reserve the right to amend this privacy policy from time to time; please review it periodically. We maintain the option to modify this privacy at any time by electronic notice posted on the  Site. Your continued use of the Site after the date that such notices are posted will be deemed to be your agreement to the changed terms.
